Q. I am a returning international student and also a native resident of Hyderabad. I need change of status of my visa from an H-4 to F-1. Can I fix for an emergency student visa interview at the Hyderabad consulate to return to school for my next semester? I heard that students applying for a student visa are being told to fix the appointment at the Chennai American consulate.

A. If you have not previously been refused, you may take an emergency appointment. However, we know student season has arrived and we will open enough appointments for all students. We are not recommending that students go to the Consulate General in Chennai. As of this writing, we have more than enough interview slots for students and we encourage you to apply here in Hyderabad.

I have been denied US visa previously. How Can I get B1/B2 visa to visit to USA?

Successful applicants for B1/B2 visas must be able to demonstrate to the interviewing officer that they have a residence outside of the United States to which they will return at the end of their temporary stay in the U.S. They also need to demonstrate that they will be able to pay for their trip and that they will stay in the appropriate visas status.

For example, someone issued a B1/B2 visa cannot work in the United States. Applicants have only a few moments to make their case to the Consular Officer, who will take into account a variety of factors in making their decision. The Officer will also enter notes into our system so that future officers can see what happened. After an application is turned down, applicants are always welcome to reapply. However, if the applicant cannot show a change from the previous situation, the result is likely to be the same.

Is it possible to request for cancellation of my visa application after interview when the passport has not yet been received and the reason for the journey to US no longer exists? I have to attend a scientific confer ence in US. Due to my nature of work I have been asked to submit additional documents under 221(g) which I have done so on the same day. If due to some administrative reasons my application is pending beyond the date of the conference, could I request for cancellation of my application? Suppose my application has been approved and it’s too late for me to travel, will I have to go through the same process? Should I apply for a visa under the same category and for a similar reason?

You can cancel your appointment. However, you cannot cancel your application once we have begun processing it. Attempting to cancel a current application with the plan to apply in a different category will not be of much help. You will probably face the same delays no matter what the category. The situation you describe in Part B is handled on a case by case basis at the time of application.

I and my wife have submitted our passports for renewal. Both have multiple entry visas valid till 10th July 2011. Please clarify whether we need to get these valid Visas also renewed, along with our passports, since t heir expiry dates are different and hold good, or can we approach you later, before their expiry in 2011?

Your U.S. visas are valid until July 2011. You can travel on your new passports but will need to attach your old passports to them to show your valid visas. You may apply for a new U.S. visa any time you wish; the choice is yours. However, you will not need a new visa to enter the country until your current visa expires.

I am an American citizen living in India for many years now. I am not a PIO. If I take Indian citizenship, will I have to give up my passport and, if so, to whom will I have to give it to.

U.S. law does not mention dual nationality or require a person to choose one citizenship or another. So while the U.S. Government recognizes that dual nationality exists and permits Americans to have other nationalities, it does not encourage it as a matter of policy due to problems it may cause.

The concept of dual nationality means that a person is a citizen of two countries at the same time. Persons may have dual nationality by automatic operation of different laws rather than by choice. For example, a child born in a foreign country to U.S. citizen parents may be both a U.S. citizen and a citizen of the country of birth.

Also a U.S. citizen may acquire foreign citizenship by marriage, or a person naturalized as a U.S. citizen may not lose the citizenship of the country of birth. It is important to note that a person who is automatically granted another citizenship does not risk losing U.S. citizenship.

However, each country has its own citizenship laws based on its own policy. A person who acquires a foreign citizenship by applying for it may lose U.S. citizenship. In order to lose U.S. citizenship, the law requires that the person must apply for the foreign citizenship voluntarily, by free choice, and with the intention to give up U.S. citizenship. Intent can be shown by the person’s statements or conduct. Americans can renounce U.S. citizenship in the proper form at U.S. embassies and consulates abroad.

My father is 65-years-old and cannot hear properly. He is planning to apply for a visitor’s visa. Is there any way that someone can accompany him to the interview?

In some cases, applicants may be accompanied by a family member for their interview. However, you need to contact our staff at HYDNIV@state.gov to get access to the consulate approved for the person who is accompanying the applicant.
